Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Bend Family Loop website, app, and any associated features or services (collectively, the “Service”), operated by VanDuffie Media, LLC, doing business as Bend Family Loop (“BFL,” “we,” “us,” or “our”).

By creating an account or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.

Bend Family Loop is a subscription-based app and website that helps families in Bend, Oregon discover local events, activities, and resources. The Service includes:

• An events discovery feed with filtering by age, interest, location, and schedule
• Personalized event recommendations based on your household's children and interests
• A shared household calendar for saving events
• Administrative tools and content available to subscribers

Some features — including public event pages and the newsletter — are available without a subscription. Filtered event discovery, the For You feed, the household calendar, and household sharing require an active paid subscription or free trial.

3.1 Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you are 18 or older.

3.2 Account creation

You may sign in using Google OAuth or an email/password combination. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3.3 Accurate information

You agree to provide accurate, current, and complete information when creating your account and to keep it up to date.

3.4 One account per person

Accounts are for individual use. You may not create multiple accounts to circumvent subscription limits or free trial restrictions.

4.1 Plans

Paid subscriptions are available on a monthly ($9.99/month) or annual ($89.99/year) basis. Prices may change with notice; changes apply at your next renewal.

4.2 Billing

Subscriptions are billed automatically at the start of each billing period via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.3 Free trial

New users may access a 7-day free trial without a credit card. Trials are limited to one per person. Creating multiple accounts to obtain additional trials is prohibited. At the end of the trial, access ends unless you start a paid subscription.

4.4 Cancellation

You may cancel your subscription at any time through your Profile under Subscription, or by managing your billing via the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused time on monthly or annual plans.

4.5 Payment failures

If a payment fails, we will notify you by email. If payment is not resolved, your subscription may be downgraded or suspended.

A single subscription covers up to two household members. You may invite one additional user (a partner or co-parent) to share your subscription. Household sharing is intended for members of the same household. You may not share access with individuals outside your household.

The secondary user accesses the Service under the primary subscriber's plan. Removing a secondary user from your household immediately ends their access.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Scrape, crawl, or otherwise extract content from the Service in bulk without written permission
• Impersonate another person or misrepresent your affiliation with any individual or organization
• Interfere with or disrupt the operation of the Service
• Create multiple accounts to circumvent restrictions or obtain additional free trials
• Use the Service to transmit spam, unsolicited communications, or malicious content

You may submit event listings or other information through forms on the Service. By submitting content, you:

• Represent that you have the right to submit it and that it is accurate
• Grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and promote the submitted content in connection with the Service
• Understand that submitted event listings may be edited, rejected, or removed at our discretion

We are not responsible for the accuracy of user-submitted content and do not endorse any event, business, or individual listed through user submissions.

Event listings on the Service are sourced from automated scraping, manual intake, and business submissions. We make reasonable efforts to keep listings accurate and up to date, but we do not guarantee the accuracy, completeness, or timeliness of any event information. Always verify event details directly with the organizer before attending.

BFL is not responsible for cancelled events, changed times or locations, registration issues, or any other matter related to third-party events listed on the Service.

All content on the Service that is not user-submitted — including the BFL brand, logo, design, copy, event curation, Field Guide articles, and software — is owned by or licensed to VanDuffie Media, LLC and is protected by copyright, trademark, and other applicable laws.

You may not reproduce, distribute, or create derivative works from BFL's proprietary content without written permission.

The Service integrates with or links to third-party services including Stripe (payments), beehiiv (newsletter), Supabase (data storage), and event organizer websites. These third parties have their own terms and privacy policies. We are not responsible for the practices or content of any third-party service.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of any content, including event listings.

To the fullest extent permitted by law, VanDuffie Media, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. If we terminate your account without cause, we will refund any prepaid subscription fees on a prorated basis.

You may close your account at any time by contacting us at megan@bendfamilyloop.com.

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Deschutes County, Oregon, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top and notify active subscribers by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
